Terms and Conditions

General

These terms apply to your purchase of services from PoliticalNewsToday.com, LLC (PNT) hereafter known as the "Service".

Provision of Service

PNT shall provide you ("Customer") with the Service. The Service shall be generally available 24 hours a day, seven days a week except for service maintenance times about which PNT.com shall advise the Customer.

PNT will provide Customer with a Login ID code, unique password or other log-in information that is required to enable connection to the Service.

Registration; Subscriber Qualifications.

As part of the registration process, you will select a password and provide certain information about yourself. You must provide accurate, complete, and current registration information and you agree to provide PNT with any of that information promptly if any changes occur.

Subscriptions to the Service are available to individuals, businesses, corporations, organizations, federal, state and local government agencies and departments, educators and students. The right to use the Service is personal to the subscriber and cannot be transferred to any other entity.

You are responsible for all use of your account under your password by any person whether or not authorized by you and for ensuring that all use of your account complies with this Agreement.

PNT.com retains the right to alter these charges from time to time. Customer shall be given one month written notice, by letter, facsimile or electronic mail, of any such alterations.

Customer agrees to pay all charges in advance via credit card or check. Should check returned for lack of funds or should credit card number expire or should PNT.com otherwise be unable to debit valid charges to this credit card number, PNT.com may immediately and without notice withdraw Customer's access to the Service.

You agree to pay all fees and charges incurred by you or any third party using your Service account (whether or not authorized by you) at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to, applicable taxes and charges for any products or services offered by PNT.com.

Customer Responsibilities

The Customer agrees it is his/her responsibility to provide computer, software, modem, telephone line or other equipment or software as is necessary to access the Service.

The Customer agrees not to assign or otherwise transfer this Agreement or Customer's rights under it, delegate Customer's obligations or resell the Service.

The Customer is responsible for the selection and use of security features, non- disclosure of personal log-in information and back up of any information.

Customer is responsible for all use of the Service accessed through Customer's password. Disclosure or loss of log-in information or Service misuse is Customer's responsibility and should be reported to PNT.com as soon as possible.

The use of the Service is at Customer's sole risk and is entirely Customer's responsibility. PNT.com does not and cannot monitor or control the content and information accessed via the Service and PNT.com shall not be held responsible in any way for any content or information accessed via the Service.

The Customer will not use the Service so as to interfere with or disrupt network users, services or equipment. Disruptions include, but are not limited to, distribution of unsolicited advertising, propagation of computer worms and viruses, using the network to make unauthorized entry to any other machine accessible via the Service, sending harassing or threatening electronic mail and forgery (or attempted forgery) of electronic mail messages and Usenet news postings.

The Customer agrees to refrain from mass posting of messages to inappropriate Usenet newsgroups. The Customer agrees to refrain from mass, unsolicited e-mailings. The Customer agrees to post advertisements only where appropriate, and in venues that specifically encourage or allow advertising. The Customer agrees to respect the conventions of the newsgroups, lists and networks to which the customer is posting, including rules more restrictive than, but not limited to, the above.

The Service may not be used by any individual or group of persons for any activities of an illegal or fraudulent nature.

Termination of service.

You may terminate your account at any time by completing the "Cancel Empirepage.com Subscription" form. PNT.com makes no promise that it will refund part or all of your subscription fee. We will evaluate each request for a refund on a case by case basis.

PNT.com may change, suspend or discontinue all or any aspect of the Service at any time, including the availability of any Service feature, database, or content, without prior notice or liability.

Rules of Conduct

You shall not post on the Service any Content which (a) is libelous, defamatory, obscene, pornographic, abusive, harassing or threatening, (b) contains viruses or other contaminating or destructive features, (c) violates the rights of others, such as Content which infringes any copyright, trademark, patent, trade secret or violates any right of privacy or publicity, or (d) otherwise violates any applicable law. You may not post on the Service any links to any external Internet sites that are obscene, pornographic, libelous or defamatory. You shall not use the Service for any commercial purpose, to distribute any advertising or solicitation of funds or goods and services or to solicit users to join competitive online services.

The Service may contain links to sites on the Internet which are owned and operated by third parties (the "External Sites"). You acknowledge that PNT.com is not responsible for the availability of, or the content located on or through, any External Site. You should contact the site administrator or Webmaster for those External Sites if you have any concerns regarding such links or the content located on such External Sites.

Indemnity

You hereby agree to indemnify, defend and hold PNT.com and all officers, directors, owners, agents, information providers, affiliates and licensors (collectively, the "PNT.com Parties") harmless from and against any and all liability, losses, costs and expenses (including attorneys' fees) incurred by any PNT.com Party in connection with any claim arising out of any use or alleged use of your account or password by any person, whether or not authorized by you. PNT.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with the defense of such claim.

Privacy Policy

PNT.com maintains a Privacy Policy governing the use of information obtained from its clients.

Disclaimer of warranties; Limitation of Liability

Neither PNT.com nor any provider of third party content or their respective agents warrants that the Service will be uninterrupted or error free; nor does PNT.com, any third party content provider, or their respective agents make any warranty as to the results to be obtained from use of the Service or the content. The Service and the content are distributed on an "as is, as available" basis. None of PNT.com, third party content providers and/or their respective agents make any warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose, with respect to the Service, any content or any products or services sold through the Service. Neither PNT.com nor any third party content provider warrants that any files available for downloading through the Service will be free of viruses or similar contamination or destructive features. You expressly agree that the entire risk as to the quality and performance of the Service and the accuracy or completeness of the content is assumed solely by you.

Notices

All notices to be served on either party by the other shall be in writing and shall be sent by hand delivery, post or facsimile, or electronic mail to the parties hereto at their respective addresses as specified on the Subscription Agreement form.

Governing Law

This Agreement shall be governed by the laws in force in the State of New York and each party hereto submits to the exclusive jurisdiction of the Courts of that State.

Our Privacy Policy

PoliticalNewsToday.com, LLC, publisher of The Empire Page (www.empirepage.com), and other websites, (hereafter referred to collectively as "PNT.com") is committed to maintaining the privacy of any personal information that is provided by subscribers or other users of the website. This Privacy Policy describes how we treat personal information received about you when you visit PNT.com.

PNT.com may make content or services from other Web sites, including affiliated or co-branded Web sites, available to subscribers from links located on PNT.com. These other Web sites are not subject to this Privacy Policy. We recommend that you review the privacy policy at each such Web site to determine how that site protects your privacy.

Information We Collect

General: When you subscribe to a PNT.com website, and at other times, we will collect personally identifiable information from you that may include your name, surface mail address, e-mail address, credit card number and other facts about you. However, we do not keep, store or retain credit card information on our servers after the transaction has been completed.

We do not knowingly collect personal information from children under the age of thirteen.

Surveys: We may conduct occasional online surveys. For example, when you're within our Web site, you may see a pop-up window offering you the optional opportunity of participating in a survey. These surveys are entirely voluntary and you may decline to participate.

Web Site Usage Information: We automatically collect IP addresses and Web site usage information from you when you visit our Web site. This information helps us evaluate how our visitors and subscribers use and navigate our sites on an aggregate basis, including the number and frequency of visitors and subscribers to each Web page, and the length of their visits.

How We Use Collected Information

We may use information in the following ways:

o For the purposes for which you specifically provided the information including, for example, to enable us to process, validate and verify subscriptions.

We may disclose and use personally identifiable information in special circumstances where it is necessary to enforce our Subscriber Agreement or Terms of Use (for example, when necessary to protect our intellectual property rights). We may also disclose or use your personal information when we, in good faith, believe that the law requires us to do so.

Cookies

We employ “cookie” technology to help visitors and subscribers move faster through our site. When you sign on to our Web site or take advantage of several key features, we may pass cookies to your computer. A cookie is a string of information that is sent by a Web site and stored on your hard drive or temporarily in your computer's memory.

Ads

PNT.com may use Web beacons (invisible images often referred to as pixel tags or clear GIFs) to note which PNT.com pages you visit after viewing our ads. The information that is collected through the use of these images is not personally identifiable and is used only to track response to our advertising efforts.

Security

The personally identifiable information we collect about you is stored in limited access servers. We will maintain safeguards to protect the security of these servers and your personally identifiable information.

Review and Correction

You may review and update the personally identifiable information/registration information that you have provided to us by contacting us at editor@empirepage.com.

Policy Modifications

We may change this Privacy Policy from time to time. We will post any changes here, so be sure to check back periodically.

Transfer to U.S.

If you are located outside of the United States, please note that the information you provide to us will be transferred to the United States. By subscribing to PNT.com, you consent to this transfer.

PoliticalNewsToday.com, LLC (PNT) was founded in 2000 in order to take over management of the Empire Page and to explore other opportunities to aggregrate political news content. The founding partners were Wynantskill Capital, the Schwartz Heslin Group of Latham New York and Empire Information Services, Inc. (EIS). In 2004, EIS became the managing partner of PNT. (In 2007, EIS changed its name to readMedia, Inc.)

At the end of 2007, readMedia's shares of PNT.com stock were purchased by Peter G. Pollak, who currently serves as Managing Partner of PoliticalNewsToday.com LLC as well as Publisher and Editor of The Empire Page.

PNT's goal for the Empire Page is to maintain its role as the website that people who are active in and care deeply about NYS government and politics can rely on for information and opinion presented without a partisan bias. Delivery to subscribers includes daily of links to 300+ news stories, editorials and columns drawn from national, regional and local news outlets. We also promote the discussion of the issues of the day through guest editorials, exclusive columns/blogs, interviews, roundtables and other pages that are not restricted to subscribers.

New features have been added recently to extend that franchise by providing more information while at the same time making it easier to find the information people need to have. These include 10 separate topical pages for subscribers, interviews conducted with people who have solutions, and roundtable discussions of important topics by the Empire Page's regular columnists and editor.
